Terms of Service

1. Acceptance of Terms

By accessing or using First Crack ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We reserve the right to update these terms; continued use after changes constitutes acceptance.

2. Description of Service

First Crack provides desktop software for coffee roasting profile management, live roast monitoring, batch history, and related production tools, with optional cloud sync and account services. The Service includes a native desktop application (macOS and Windows), associated web account and billing pages, and APIs we operate.

3. Accounts & Registration

• You must be at least 16 years old to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate, current registration information.
• You may not share your account with unauthorized users.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions & Payments

• Free plan: Basic desktop features limited to 20 batches per calendar month. No paid subscription is required to remain on Free.
• Paid plans (Pro, Pro+, Enterprise): Billed monthly or annually as selected at checkout. Prices are shown and charged in the currency for your market (USD, KRW, or JPY). Current feature limits are described on our pricing pages and product documentation.
• Trial: Checkout for Pro or Pro+ may include a 14-day trial with a 20-batch limit during the trial period. Cancel before the trial ends to avoid the first paid charge. If you do not continue on a paid plan after the trial, you may remain on the Free plan (20 batches per month).
• Cancellation: You may cancel a paid subscription at any time. Access to paid features continues until the end of the current billing period.
• Refunds: Fees are non-refundable except where required by applicable law or for clear duplicate charges caused by our payment system. We do not provide prorated refunds for partial billing periods. If you cancel mid-cycle, you retain access until the period end date; unused time is not refunded.
• Price changes: We will notify you 30 days before any price change. Continued use after the change constitutes acceptance.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or extract the source code of the desktop application.
• Upload malicious code, viruses, or anything that disrupts the Service.
• Interfere with other users' access to the Service.
• Use automated bots or scrapers without our written permission.

6. Data Ownership

• Your data: You retain full ownership of all roast profiles, batch notes, and other data you upload to First Crack.
• License to us: You grant First Crack a limited license to store, process, and display your data solely to provide the Service to you.
• Anonymized data: We may use anonymized, aggregated data for platform improvement and benchmarking. This data cannot identify you or your roastery.

7. Limitation of Liability

First Crack is provided "as is" without warranties of any kind, either express or implied. We are not liable for:

• Loss of roast data due to user error or failure to back up.
• Decisions made based on platform analytics — roasting decisions remain the responsibility of the user.
• Downtime or service interruptions beyond reasonable efforts to maintain uptime.
• Indirect, incidental, or consequential damages arising from use of the Service.

8. Termination

We may terminate or suspend your account immediately if you materially breach these terms. Upon termination:

• Your access to the Service ceases.
• We will provide a 30-day window to export your data before permanent deletion.

9. Governing Law

These terms are governed by the laws of the Republic of Korea. Any disputes shall be resolved in the courts of Seoul, South Korea.
